Acceptable Use Policy

1. Agreement

This Acceptable Use Policy (“AUP”) governs use of PrivacyRadar’s marketing-site scans, authenticated product, APIs, findings, evidence artifacts, and reports (the “Services”). By submitting a URL or using the Services, you agree to this AUP.

This AUP is not a complete Terms of Service. It sits alongside the Privacy Policy at /privacy. If a later customer agreement conflicts with this AUP on scan authorization or permitted purpose, this AUP controls those topics until a signed Order Form says otherwise.

Findings describe observed technical behavior and the presence or absence of detectable disclosure language, with statute references. They are not legal conclusions. PrivacyRadar does not provide legal advice, compliance certification, or liability guarantees.

2. Authorized-asset warranty

You represent and warrant that, for every URL, domain, application, or other digital property you submit (including free or public scans):

  • You own the property, or you have written authorization from the owner to scan it (including a written engagement letter if you are a law firm or consultant); and
  • You will not target a third party’s property for the purpose of investigating, valuing, or asserting claims against that third party.

3. Proof of authorization

You will keep that authorization for as long as related scan artifacts exist and will produce it if we ask. PrivacyRadar may suspend scans, withhold signed reports, or terminate an account if this warranty is untrue or unverifiable.

Scans are limited by product design: private networks and cloud metadata endpoints are blocked; default scans do not submit forms; consent clicks use allowlisted controls only.

4. Permitted purpose

You may use the Services and outputs only to:

  • Operate, secure, and defend your own authorized properties.
  • Remediate observed runtime behavior (consent, trackers, disclosure gaps).
  • Share outputs with your retained defense counsel, insurers, auditors, and regulators under confidentiality, in support of your own compliance or defense.

5. Prohibited purpose — plaintiff-side case generation

You shall not, and shall not permit any user or downstream recipient to, use the Services or outputs to:

  • Identify, develop, value, underwrite, or assert claims against a third party.
  • Perform plaintiff-side case generation, complaint-drafting support, or docket shopping.
  • Screen matters for litigation finance, claims aggregation, or mass-arbitration origination.
  • Resell or republish findings, hashes, screenshots, HARs, or PDFs as legal intelligence or a substitute for a case-origination lab.
  • Build or train a competing case-origination or dollar-exposure engine on outputs.
  • Circumvent free-tier limits to obtain a signed LEGAL evidence PDF without a paid organization that has completed our onboarding review.

6. Public web is not a license to sue

These prohibitions apply even if the scanned URL is publicly accessible. Observing a public page is not permission to industrialize claims against its operator. Sections 5 and 6 survive termination of your account.

7. Law firms and consultants

Scanning your own marketing or recruiting sites is allowed, subject to this AUP.

Scanning a client’s properties is allowed only under a written defense or counseling-the-company engagement, if the client is the warranting owner or authorizer in Section 2 and the purpose is Section 4. Keep the engagement letter. We may require you to name the client, produce the engagement, and confirm in-scope hosts before enabling signed LEGAL exports. Failure to produce is treated as prohibited use.

Plaintiff-side investigation, demand-letter mills, class origination, litigation-finance screening, and “what I would collect on an adversary” research are not allowed. Do not create an account for those uses. Do not expect signed LEGAL PDFs.

Insurers and brokers: loss-control evidence for a named insured may be addressed in a separate written agreement. This AUP does not authorize underwriting scores, premium-reduction claims, or portfolio screening of non-customers.

8. Free and public scans

Unauthenticated and free-tier scans may return a redacted summary of observations. They do not produce an Ed25519-signed LEGAL PDF, a chain-of-custody evidence inventory suitable as a complaint exhibit, or a litigation-statute product.

Signed LEGAL PDFs are available only to paid organizations that have completed our onboarding review, on authorized assets.

9. Suspension

Without limiting other remedies, PrivacyRadar may refuse a signup, freeze LEGAL export, or terminate an account for prohibited use or a failed warranty, and may preserve scan metadata needed to investigate abuse.
